These Terms of Service ("Terms") govern your use of the website at orchaitech.com (the "Site") and, together with any project-specific service agreement, your engagement with Orchai Technologies sp. z o.o. ("Orchai Tech", "we", "us", or "our") for consulting and development services.

By using the Site or contacting us to engage our services, you confirm that you have read and agree to these Terms. If you are engaging us on behalf of a company or other legal entity, you confirm that you have authority to bind that entity to these Terms.

1. About us

Orchai Technologies sp. z o.o. is a limited liability company registered in Poland, with its registered office at Hetmańska 82a, 60-219 Poznań. We provide AI agent consulting, custom agent development, and process automation services to businesses in Poland and across the European Union.

2. Use of the website

You may use the Site for lawful purposes only. You agree not to use the Site in any way that: violates applicable law; is fraudulent, deceptive, or harmful; infringes the rights of any third party; introduces malware, spam, or other harmful code; or attempts to gain unauthorised access to any part of our systems.

You may read, share links to, and quote briefly from our Field Notes for non-commercial purposes, provided you attribute the source with a link to the relevant page. You may not reproduce substantial portions of our content, adapt it for commercial use, or represent it as your own work without our written permission.

4. Services and project engagements

Our consulting and development services are provided under separate service agreements negotiated with each client. These Terms govern general website use and initial enquiries. The specific scope, deliverables, timelines, fees, and ownership of work product for each project are set out in the relevant service agreement.

Enquiries submitted via our contact form do not constitute a binding agreement and do not create any obligation on our part to provide services.

5. Accuracy of information

We make reasonable efforts to ensure the content on the Site is accurate and current. Field Notes are written to reflect our experience and views at the time of publication and may not reflect subsequent developments in the field. Nothing on this Site constitutes legal, financial, or technical advice applicable to your specific situation. For advice specific to your circumstances, consult a qualified professional.

7. Limitation of liability

Our total liability to you for any claim arising from your use of the Site (excluding services provided under a separate agreement) shall not exceed €100.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

8. Governing law and disputes

These Terms are governed by Polish law. Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Poznań, Poland.

If you are a consumer (i.e. you are not engaging us in a professional or business capacity), you may also have rights under your local consumer protection law that cannot be excluded by these Terms.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be noted by an updated date at the top of this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
